Vehicle Reservation Terms and Conditions

  1. Introduction

    1.1. These terms and conditions ("T&Cs") apply to the reservation of a vehicle via our Mazda online sales portal at https://shop.mazda.co.uk (the "Sales Portal"). The online reservation of a vehicle entitles you to reserve a vehicle during an agreed reservation period, to the exclusion of other Sales Portal users (an "Online Reservation").

    1.2. These T&Cs do not constitute a contract for the sale of any vehicle and you are not obliged to purchase any vehicle which you reserve.

    1.3. Please read these T&Cs carefully and make sure that you understand them. You will be asked to tick a box to confirm that you have read and accept these T&Cs. Acceptance of these T&Cs is required in order to make an Online Reservation, therefore if you do not agree with any of these T&Cs you should not proceed with the Online Reservation. As explained below, no Online Reservation shall be confirmed until you have paid the Refundable Reservation Fee and received from us an email to confirm that the reservation has successfully made ("Confirmation Email").

    1.4. We may amend T&Cs from time to time as set out at Clause 5.2 below. You should check the T&Cs each time you wish to make an Online Reservation in order to ensure that you are aware of all of the T&Cs which will apply at that time. These T&Cs were last updated on 30th November 2021.

  2. Information about us and how to contact us

    2.1. We are Mazda Motors UK Limited, a company registered in England (company number 04212655) and our registered office is at Victory Way, Crossways Business Park, Dartford, England, DA2 6DT (“we”, “us”, “our”). Our VAT number is GB771979668.

  3. Making an Online Reservation

    3.1. In order to make an Online Reservation you are required to complete the online reservation request, tick the relevant box to signify your acceptance of these T&Cs and pay a fully refundable reservation fee of £99 (the "Refundable Reservation Fee"). We are unable to accept any Online Reservation until you have completed all three of these actions.

    3.2. Please carefully check all information submitted as part of the online reservation request, in particular, your contact details and the details of the vehicle which you would like to reserve. Failure to do so may result in the Online Reservation being rejected or the wrong vehicle being reserved. Mazda shall have no liability as a result of any errors which are made by customers in completing any online reservation request.

    3.3. Payment of the Refundable Reservation Fee is to be made via our payment processor Mollie. You can pay the Refundable Reservation Fee by credit card or debit card (we accept both MasterCard and Visa). All payments by credit card or debit card need to be authorised by the relevant card issuer.

    3.4. Upon receipt of the Refundable Reservation Fee, we will send you an email to confirm that we have accepted your reservation ("Confirmation Email"). Alternatively, if we are unable to accept the Online Reservation for any reason we will notify you of such and return to you any Refundable Reservation Fee that has been paid in full (and we will have no further liability to you or anyone else in those circumstances). Please check your spam folder or adjust your spam filter settings for the relevant email. If you have not received a Confirmation Email or notification that the Online Reservation has not been accepted within 1 hour of making the Online Reservation then please contact us at the email address specified at clause 2.2 above for clarification.

    3.5. Upon issue by us of a Confirmation Email, the Online Reservation is made and these T&Cs shall become binding upon you, at which point a “Contract” shall come into existence between you and us.

    3.6. By making an Online Reservation, you agree to be contacted by Mazda or the selected dealer as part of the Online Reservation, the subsequent purchase process and with regard to further Mazda and dealer information.

    3.7. Once the Online Reservation has been made, the vehicle which you have reserved ("Reserved Vehicle") will be removed from our Sales Portal for a period of 72 hours from the date of the Confirmation Email ("Online Reservation Period").

    3.8. Irrespective of whether or not you enter into any discussions with Mazda or any dealer regarding the Reserved Vehicle, and/or proceed with the purchase of the Reserved Vehicle, we will refund the Refundable Reservation Fee to you in full at the end of the Online Reservation Period via the same method as you have used to pay it. The refunded Refundable Reservation Fee will be processed the next business day and may take up to 14 days to appear in your account, depending on the bank. The refund will be shown as a refund referencing Mazda and/or Mollie.

    3.9. We reserve the right to amend the Refundable Reservation Fee at any time. Any changes to the Refundable Reservation Fee will not affect any reservations you have made prior to such change taking effect and you will always be refunded the same amount of Refundable Reservation Fee as you have paid, irrespective of any subsequent change to the Refundable Reservation Fee which we might make.

    3.10. Payment of the Refundable Reservation Fee shall in no circumstances constitute a deposit or payment towards any vehicle or any other goods or services.

    3.11. If, at the end of the Online Reservation Period you decide to purchase the Reserved Vehicle, the Reserved Vehicle will not become available for reservation or purchase by anyone else, unless you cancel your purchase in line with the terms of the contract for the sale of the Reserved Vehicle.

    3.12. If, at the end of the Online Reservation Period you decide not to purchase the Reserved Vehicle, the Reserved Vehicle will become available via the Sales Portal for reservation or purchase by other Sales Portal users.

  4. Our responsibility to you for loss or damage suffered by you

    4.1. We will do all that we reasonably can to ensure that all of the information you provide when making payment of the Refundable Reservation Fee is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you provide to us.

    4.2. We are only liable to you for losses which you suffer as a direct result of our breach of these terms and conditions and which are reasonably foreseeable. We are not liable for any other losses. Loss is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both we and you knew it might happen, for example, if you discussed it with us during the reservation process.

    4.3. We are not liable for business losses. If you are a consumer we only provide the Online Reservation service to you for domestic and private use. If you use the services for any commercial or business purpose our liability to you will be limited as set out in Clause 4.4 below

    4.4. Our responsibility for loss or damage suffered by you if you are a business,

    Subject to Clause 4.5 below:

    4.4.1. we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and

    4.4.2. our total liability to you for all other losses arising under or in connection with any Contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to of the total amount of Refundable Reservation Fee paid by you under such Contract.

    4.5. We do not in any way exclude or limit our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any matter for which it would be illegal for us to exclude or attempt to exclude our liability.

  5. Other important terms

    5.1. Reserved Vehicles may only be driven (for test-drive purposes or otherwise) by persons holding a valid UK driving licence and subject to such terms and conditions for test drive which may operate in the Mazda dealer where the Reserved Vehicle is viewed.

    5.2. We may amend these terms and conditions from time to time. Please look at the top of this page to see when these terms and conditions were last updated. Every time you reserve a vehicle, the terms in force at the time of your reservation will apply between you and us.

    5.3. You may not transfer any of your rights under the Contract to any other person. We may transfer any of our rights under the Contract to any person or ask any person to fulfil any aspect of it so long as the performance of the Contract is not affected.

    5.4. Only you and us have any rights under the Contract. No other person shall have any rights under the Contract.

    5.5. Each of the clauses in these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

    5.7. These terms are governed by English law and you can bring legal proceedings in the English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.
